How Indiana Jurisdiction Works

Where to File — The General Rule

In Indiana, most civil and family law cases must be filed in the county where at least one party resides. For divorce, Indiana law (IC 31-15-2-6) requires that at least one spouse have been a resident of Indiana for six months and a resident of the filing county for three months immediately before the petition is filed. Custody, paternity, and child support matters follow a similar rule — the case is generally filed where the child resides or where the parties reside.

Protective orders under Indiana's civil protective order statute (IC 34-26-5) can be filed in the county where the petitioner resides, where the respondent resides, or where the abuse occurred — giving petitioners some flexibility when safety is a concern. Emergency protective orders may be obtained at any time through local law enforcement or an on-call judge.

Criminal charges are filed in the county where the alleged offense occurred, regardless of where the defendant lives. Drug charges, for example, are prosecuted by the county prosecutor where the possession or dealing took place. CHINS cases are initiated by the Indiana Department of Child Services and filed in the county where the child resides at the time DCS becomes involved.

For post-conviction relief and appeals, jurisdiction is different. PCR petitions are filed in the county where the original conviction occurred. Appeals go to the Indiana Court of Appeals in Indianapolis — regardless of which county the trial took place in — making them statewide in nature.
